LIABILITY RELEASE, ASSUMPTION OF RISK, AND ELECTRONIC SIGNATURE

This is a legally binding agreement. Read all of it before you sign.

1. Parties. I am signing for myself. The released parties are Watauga Perch, its owners, hosts, staff, volunteers, contractors, and agents (together, "Host").

2. Activities. Gatherings at the property and nearby Watauga Lake may include time on the property, porch and fire pit, walking on uneven ground, swimming or wading, boating, fishing, travel to public ramps and marinas, and similar outdoor recreation. Weather, water, boats, and other people change the conditions.

3. Assumption of risk. I understand these activities have inherent risks, including injury, illness, drowning, property damage, and death. I take part voluntarily and assume those risks for myself.

4. Release. To the fullest extent allowed by Tennessee law, I release and discharge the Host from claims arising from ordinary negligence in connection with the gathering I am signing up for, including claims for injury, death, or property damage.

5. What this does not cover. This agreement does not release the Host from liability for gross negligence, recklessness, or intentional misconduct. Tennessee courts will not enforce a waiver of those kinds of harm.

6. Indemnity. I will indemnify and hold the Host harmless from claims brought by others that arise from my own conduct at the gathering, except to the extent caused by the Host's gross negligence, recklessness, or intentional misconduct.

7. Medical care. If I am hurt, I authorize reasonable first aid and emergency medical care. I am responsible for the cost of my medical care.

8. Minors. Tennessee law does not allow a parent or guardian to waive a minor child's own right to bring a claim. If I bring a child under 18, I am signing only for my own claims. I am responsible for supervising that child. Listing a child's name is for attendance and safety, not a waiver of the child's claims.

9. Electronic records. I agree to complete this registration and release electronically. I can print this page. A copy will be emailed to the address I provide. I need a current web browser and email to keep that copy. To withdraw consent to electronic records, I email the host; withdrawing consent cancels this registration. I may request a paper copy by emailing the host; no extra fee is charged for that copy.

10. Signature. By typing my legal name and checking the required boxes, I intend to sign this agreement. That electronic signature is my signature under the federal ESIGN Act and Tennessee's Uniform Electronic Transactions Act (Tenn. Code Ann. section 47-10-101 and following).

11. Governing law. Tennessee law governs this agreement. Venue is in the state courts of Carter County, Tennessee, unless the law requires otherwise.

12. Entire agreement. This is the whole agreement on these subjects. If a court finds one part unenforceable, the rest still applies.

I have had a chance to read this, ask questions by emailing the host, and get advice from my own lawyer if I wanted it.
